Panic, panic closing down Cafepress

Yesterday I was very happy and excited to open up our online shop at Cafepress. Well today I paniced, here’s the story.

As a designer I am also active on different design related forums. On one of those forums (supertalk) I posted our design and a linkup to Dutch delight.
A member DUBDLX from Addicteed (great collection of tees) warned me about the terms & conditions at Cafepress. Yes, I know I should read the TOS before using an online service, but I didn’t.

He also give me this link say-no-to-cafepress. I am glad he warned me because we want our designs to be ours (unless we sell them ofcourse).
The next thing I did was opening an online shop at spreadshirt for Europe and I will open one for the USA.
Little disappointed about their product range (no toddlers bib’s for example) and their start prices are quit high.

But their TOS reads:

Spreadshirt does not have the right to sell Partners’ designs in its own shops, or in shops of third parties or other distribution channels without the express permission of the Partner.
and they have paypal.
We will be looking around for more online shops, but in the meantime go to Dutch delight and please spread the word.

Hi there from CafePress!
I think you are mistaken with regards to our terms of service. Our terms of service explicitly say that the artists keeps all rights to their artwork and that they can close down their shop at any time.
You can read this on paragraph 4 at the following link (final line of the paragraph):

The “say no to cafepress” site you read is about three years old now - and it was wrong to begin with (it confused what sellers could do with our content versus what cafepress does with their content). We have clearly articulated in all agreements since then that seller own all rights to their content.
